Acceptable Use Policy

Effective date: April 1, 2025

1. Purpose

This Acceptable Use Policy (AUP) governs the use of PropCare's platform and services. By using the Services, you agree to comply with this policy. PropCare reserves the right to suspend or terminate access for violations.

2. Permitted Uses

  • Managing residential and commercial properties within your portfolio.
  • Communicating with tenants, contractors, and other authorized parties.
  • Processing maintenance requests, work orders, and service dispatch.
  • Collecting rent, tracking expenses, and generating reports.
  • Sending SMS notifications to tenants for legitimate property-related purposes — including maintenance updates, appointment confirmations, and property notices — where the tenant has provided prior express written consent.
  • Any other lawful activity consistent with the purpose of the platform.

3. Prohibited Uses

  • Using the platform for any unlawful purpose or in violation of applicable laws.
  • Harassing, threatening, or discriminating against tenants, contractors, or other users.
  • Sending SMS messages to tenants who have not provided prior express written consent, or who have previously opted out.
  • Using PropCare's messaging features for commercial solicitation, marketing, or any purpose unrelated to property management.
  • Re-enrolling a tenant in SMS communications after they have replied STOP or otherwise withdrawn consent.
  • Uploading or transmitting malware, viruses, or any malicious code.
  • Attempting to gain unauthorized access to other accounts or PropCare systems.
  • Using the AI features to generate false, misleading, or defamatory content.
  • Reselling or sublicensing access to the platform without written authorization.
  • Scraping, crawling, or extracting data from the platform in an automated manner.
  • Using the platform to violate housing laws, privacy rights, or human rights codes.

4. SMS Messaging Standards

  • Operators must obtain prior express written consent from tenants before sending any SMS message through PropCare. Consent must be documented and retained by the operator.
  • Each SMS program must clearly identify PropCare and the operator as the sender, state the purpose of the messages, and include instructions for opting out (e.g., 'Reply STOP to unsubscribe').
  • Operators must honour all STOP requests within 24 hours and must not send further messages to that tenant unless fresh consent is obtained.
  • Message content must be limited to legitimate property-related communications. Commercial solicitation, promotions, or unrelated marketing are strictly prohibited.
  • Operators are responsible for ensuring their tenant consent practices comply with the Canadian Anti-Spam Legislation (CASL), the Telecommunications Act, and all applicable provincial regulations.
  • PropCare reserves the right to suspend SMS functionality for any operator found to be in violation of these standards or applicable law.

5. Content Standards

All content submitted through the platform — including maintenance descriptions, broadcast messages, and communications — must be accurate, lawful, and respectful. PropCare may review and remove content that violates this policy.

6. AI Use Standards

PropCare's AI features are provided to assist with property operations. Users must not attempt to manipulate, bypass, or misuse AI systems. AI-generated outputs should be reviewed for accuracy before acting on them in high-stakes situations.

7. Reporting Violations

If you become aware of a violation of this policy, please report it to [email protected]. PropCare will investigate all reports and take appropriate action.

8. Enforcement

Violations of this AUP may result in suspension or termination of your account, removal of content, and where appropriate, referral to law enforcement authorities. PropCare's decision on enforcement matters is final.
